Takedown & DMCA

This page explains how to raise two kinds of objection: a brand takedown or dispute request (you are a brand owner and object to how your brand is referenced in the Store or in a data product) and a DMCA copyright complaint (you believe content on the Store infringes your copyright). The full, binding process is set out in our Terms of Service — Sections 11 (Third-Party Brands, Nominative Use, and Takedown), 17 (DMCA / Copyright Complaints), and 21 (Contact). This page summarizes those Terms; if anything here differs from them, the Terms control.

Brand takedown and dispute requests

Mogean's dataset references third-party business brands and names to identify the business locations the underlying facts describe. Mogean claims no trademark, sponsorship, or other proprietary right in those brands. Brand names are used descriptively and nominatively, the Store uses text wordmarks only (no third-party logos), and Mogean is not affiliated with, endorsed by, or sponsored by any brand named in the dataset.

If you are a brand owner or an authorized representative and you object to the reference to your brand in the Store or in a product, email info@mogean.com with:

• the brand and the specific Store page(s) or product(s) you object to;
• who you are and your authority to act for the brand owner; and
• what you are asking for (for example, correction or removal of the reference).

We are committed to reviewing and responding to good-faith requests and, where appropriate, to addressing them (Terms of Service §11.3).

DMCA copyright complaints

Mogean respects intellectual property rights. If you believe content on the Store infringes your copyright, send a notice to our designated agent containing the information required by 17 U.S.C. § 512(c)(3), including: identification of the copyrighted work; identification and location of the allegedly infringing material; your contact information; a statement of good-faith belief that the use is not authorized; a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the copyright owner; and your physical or electronic signature.

We may remove allegedly infringing content and may terminate the accounts of repeat infringers in appropriate circumstances (Terms of Service §17).
