Mogean, Inc., a Georgia corporation ("Mogean," "we," "us," or "our") operates the online store at www.mogean.com (the "Store"), where we sell US point-of-interest data — business-location facts such as names, addresses, coordinates, hours, and categories. This Privacy Policy explains what information we collect from the people who visit and buy from the Store, how we use and share it, and the choices and rights you have.
This Policy uses a few terms the same way our other legal documents do: the Store (www.mogean.com), a Buyer (someone who purchases from the Store), the License (the Data License Agreement at /legal/license), and the Terms (the Terms of Service at /legal/terms).
Two things up front, because they matter for how you read the rest of this Policy:
- The product we sell is business-location facts, not personal data. We do not collect or sell consumer, device, GPS, or foot-traffic data. Our dataset describes where businesses are, not where people go. It is a compilation of facts about US businesses, and it is separate from the small amount of personal information we collect about our own customers. There is one honest caveat — see "About Our Product Data" below.
- We keep the personal information we collect from customers to a minimum. The Store uses guest checkout — you do not create an account or password. In most cases the personal information we hold is just the email address you give us at checkout or when you download a free sample, plus a record of what you bought.
We aim to keep this Policy in plain English. Where a section affects your rights, we have tried to be precise without being needlessly legalistic.
1. Scope — Who and What This Policy Covers
This Policy applies to visitors to and customers of the Store, and to the personal information we collect through the Store and our related emails.
The Store is offered to customers in the United States only. At this time, Mogean does not sell to, or knowingly collect personal information from, individuals located outside the United States, and an order placed from outside the United States may be declined. If Mogean expands sales internationally in the future, this Policy will be updated accordingly before that expansion.

2. Information We Collect
We collect a small amount of information, and only what we need to run the Store and fulfill your orders.
Information you give us:
- Checkout and delivery email. When you buy from the Store, we collect the email address you provide so we can deliver your download link, send your receipt, and communicate with you about your order. Checkout is guest checkout — there is no account or password. The email address you provide at checkout is the account of record for your order: it is where we deliver signed download links (which expire 24 hours after issue and can be re-issued up to 3 times per day per order), where we send subscription and service notices, and how we identify you for support, replacement, and self-serve cancellation requests.
- Purchase history. We keep a record of your orders — what you bought, which License tier you selected, the date, and the order amount — so we can deliver your files, provide support, honor your License (including your clickwrap acceptance record), and meet our tax and accounting obligations.
- Sample-download and request emails. If you request a free sample, ask us to add a brand or dataset we don't yet carry, or ask to be notified when data ships, we collect the email address you provide so we can deliver what you asked for and, as described in "Email Communications" below, may follow up with related marketing. You can opt out of that marketing at any time.
- Tracker subscription email. If you subscribe to our monthly openings-and-closures tracker, we collect the email address you provide so we can send you each monthly issue. The tracker is a marketing newsletter — every issue includes a working unsubscribe link (see "Email Communications").
- Explorer queries. If you use the natural-language explorer, we process the text of the query you type in order to build your result. See "How Information Is Shared" for the service provider involved. Please do not include personal information in explorer queries.
Information collected automatically:
- Minimal usage and analytics data. Like most websites, our servers and a small set of analytics tools record basic technical information — for example, your IP address, browser type, pages viewed, and the general way you move through the Store — so the Store works and so we can understand and improve it. We keep this to a minimum by design. See "Cookies and Tracking Technologies."
Payment information — collected by Stripe, not by us:
- We use Stripe to process payments. When you pay, your card details go directly to Stripe. Mogean never receives or stores your full card number. We receive only limited confirmation information from Stripe (for example, that a payment succeeded and a partial card reference for support and reconciliation). See "How Information Is Shared."
We do not intentionally collect sensitive personal information (such as government ID numbers, health, or precise geolocation) from customers, and we ask that you not send it to us.
3. How We Use Information
We use the information we collect to:
- Fulfill your orders — deliver your signed download links and files, provide the product you purchased under your chosen License tier, re-issue expired download links on request, honor the replacement guarantee for wrong or corrupt files, process self-serve cancellations, and provide customer support.
- Send transactional email — order confirmations, receipts, download- delivery messages, subscription notices, and service messages, sent through our email provider (see "How Information Is Shared").
- Follow up on samples and requests — send you related marketing about our products after a sample download or a brand/data request, from which you may opt out at any time (see "Email Communications").
- Send the tracker newsletter — deliver our monthly openings-and-closures tracker to the email you used to subscribe, from which you may unsubscribe at any time (see "Email Communications").
- Operate and improve the Store — understand how the Store is used, fix problems, keep it secure, and make it better.
- Meet legal and financial obligations — keep records for tax, accounting, fraud-prevention, and compliance purposes, and respond to lawful requests.
We do not use your information to build advertising profiles, and we do not engage in cross-context behavioral advertising. We do not make decisions about you using automated decision-making that produces legal or similarly significant effects.
4. How Information Is Shared
We do not sell the personal information of our customers. We are not in the business of selling customer data, and we do not share it for cross-context behavioral advertising.
We share limited customer information with a small number of service providers who help us run the Store, and only so they can perform those services for us:
- Stripe — payment processing. Stripe processes payments on our behalf as our payment processor. Card details are handled directly by Stripe; we never store your full card number. Stripe's handling of your information is governed by Stripe's privacy policy, available at https://stripe.com/privacy.
- AWS (Amazon Web Services) — hosting and transactional email delivery. We use Amazon Simple Email Service (AWS SES) to send transactional and (where applicable) marketing email, and AWS to host the Store. AWS acts as our service provider (processor) for email delivery and hosting. AWS's subprocessor list is available at https://aws.amazon.com/compliance/sub-processors/.
- Anthropic — natural-language query processing. The Store's natural-language explorer uses a large-language model provided by Anthropic, PBC ("Claude"). When you type a query into the explorer, the text of that query (and the technical context needed to interpret it) is sent to Anthropic, acting as our service provider, to turn your words into a data query. We do not send Anthropic your checkout email, purchase history, or payment information. Anthropic's handling of this data is governed by our commercial agreement with Anthropic, under which it does not use our customers' queries to train its models; Anthropic's privacy documentation is available at https://www.anthropic.com/legal/privacy.
Our service providers are located in, or process data in, the United States.
We may also disclose information (a) to comply with law, legal process, or lawful requests; (b) to protect the rights, safety, and property of Mogean, our customers, or others; and (c) in connection with a merger, acquisition, or sale of assets, in which case we will require the recipient to honor this Policy or will notify you of any material change.
This is different from the product we sell. The point-of-interest data sold in the Store is a separate product governed by the License. When you buy that product, you are buying business-location facts — not the personal information of Mogean's customers. The "no sale of personal information" statement in this section refers to our customers' personal information. For how personal information may appear in the product data, see the next section.
5. About Our Product Data (Point-of-Interest / Business-Location Data)
We want to be straightforward about this, because it is easy to get wrong.
The product we sell is a compilation of business-location facts about US businesses — business names, addresses, coordinates, hours, and categories — sourced from businesses' own public store locators and from public US government registries. It is not consumer, device, GPS, or personal-tracking data, and it is not data about the Store's customers.
However, some records may still contain information that qualifies as personal information under certain privacy laws. For example, a sole proprietor's business may be listed under the individual's own name, sometimes at a home address, and some records may include a named contact. We do not treat "it's business data" as a reason to ignore this.
If you believe a record in our product data relates to you and you would like it corrected or removed, you can ask us to do that:
- How to ask: contact us using the details in "Contact Us," describe the record (for example, the business name and address), and tell us whether you are asking for correction or removal.
- What we do: we will verify the request as reasonably needed, and we will correct or remove qualifying records from products we generate going forward, subject to our legal obligations and technical limits. We cannot recall copies already delivered to Buyers, but we can prevent a corrected or removed record from appearing in future files and refreshes.
6. Cookies and Tracking Technologies
We use cookies and similar technologies sparingly:
- Essential cookies that are necessary for the Store to work — for example, to hold your cart and process checkout securely.
- Minimal analytics to understand how the Store is used and to improve it.
We do not use advertising cookies, and we do not share information for cross-context behavioral advertising. Our internal-only analytics is not a "sale" or "share" of your personal information under US state privacy laws.
You can control cookies through your browser settings. Blocking essential cookies may affect how the Store works. No cookie-consent banner is used; the Store is a US-only site.
Do Not Track and Global Privacy Control (GPC). Some browsers offer a "Do Not Track" signal or a Global Privacy Control (GPC) signal. Because we do not sell or share personal information for advertising and do not track you across other websites, these signals do not change what we do — there is no cross-context advertising to turn off. We disclose our response here so you know where we stand.
7. Email Communications
There are two kinds of email we may send you, and we treat them differently:
- Transactional and service email. These relate to your relationship with us — order confirmations, receipts, download-delivery links (including re-issued links), subscription and cancellation notices, and support replies. You cannot unsubscribe from these while you have an active order or subscription, because we need them to serve you: with guest checkout, your delivery email is the account of record for your order. We send these through AWS SES.
- Marketing email. If you gave us your email through a free-sample download or a brand/data request, we may send you related marketing about our products. If you subscribed to our monthly openings-and-closures tracker, we will send you the tracker and may send related marketing. Every marketing email includes a working unsubscribe link. If you unsubscribe, we will stop sending you marketing email promptly — no later than 10 business days after you opt out — and we will not charge you or make you give us extra information to do it.
We keep receipts and other transactional messages separate from marketing so each stays clear about what it is.
Legacy opt-out list. If you previously opted out of marketing from the prior version of our website, we will continue to honor that choice; you do not need to opt out again.
Our marketing email practices follow the US CAN-SPAM Act: accurate headers, a non-deceptive subject line, a clear indication that the message is an advertisement where required, a valid physical postal address, and a working opt-out.

8. Your Privacy Rights (United States)
Our baseline commitment (all US visitors). Regardless of where you live, you can ask us to review and correct the personal information we hold about you as a customer. To do so, contact us using the details in "Contact Us." We will respond within a reasonable time and may need to verify your identity first.
Additional choices we offer to all US users. Some US state privacy laws (including the California Consumer Privacy Act as amended by the CPRA) give residents specific rights. Rather than sort customers by state, we voluntarily offer the following choices to all of our US users, whether or not a given law applies to you. Offering these does not mean we are subject to, or claim coverage under, any particular state privacy statute.
- Know / access — ask what personal information we hold about you and how we use it.
- Delete — ask us to delete personal information we hold about you.
- Correct — ask us to fix inaccurate personal information.
- Opt out of marketing — unsubscribe from marketing email at any time (see "Email Communications").
We do not sell your personal information or share it for cross-context behavioral advertising, so there is nothing to opt out of on that front — but if that ever changes, we will update this Policy and provide the required opt-out.
How to make a request. Email us using the details in "Contact Us." Email is sufficient — there is no phone number to call. We may need to verify your identity before acting, and we may keep information we are required to retain by law (for example, tax and transaction records).
No retaliation (non-discrimination). We will not deny you products, charge you a different price, or give you a lower level of service because you exercised any of these choices.
Your California rights. California law (including CalOPPA and the CCPA/CPRA) requires us to disclose the categories of personal information we collect, how we share it, how you can review and request changes to it, and our response to "Do Not Track" signals. Those disclosures are in Sections 2, 4, 6, and 8 of this Policy, and the effective date is shown at the top. California residents may use the access, correction, and deletion choices described above.
9. Data Retention
We keep personal information only as long as we need it:
- Purchase records — for as long as you have an active License or subscription and afterward for as long as we need them to support your License (including proving your clickwrap acceptance), resolve disputes, and meet our legal, tax, and accounting obligations.
- Sample-download, request, and marketing emails — until you unsubscribe or ask us to delete them, and then only as long as needed to honor your opt-out (for example, to keep you off our marketing lists).
- Usage and analytics data — for a limited period consistent with keeping the Store secure and improving it.
When we no longer need personal information, we delete it or de-identify it, unless the law requires us to keep it longer.
10. Data Security
We use reasonable administrative, technical, and organizational safeguards to protect the personal information we hold — including relying on established providers such as Stripe (payments) and AWS (hosting and email), and limiting access to information to those who need it. Sensitive payment card data is handled by Stripe, not stored by us.
No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will respond as required by applicable law, including breach-notification obligations under US state law.
11. Children's Privacy
The Store is a business-to-business data store and is not directed to children. We do not knowingly collect personal information from children under 13 (or under any higher age at which applicable US federal or state law requires parental consent). If you believe a child has given us personal information, contact us and we will delete it.
12. Governing Law and Disputes
This Policy, and any dispute about our privacy practices, is governed by the law of the State of Georgia, USA, and disputes are resolved as set out in the Terms of Service — by binding individual arbitration with a class-action waiver, with a small-claims carve-out and a 30-day arbitration opt-out, as described in the Terms (§20.3). Nothing in this section takes away any right that the law of your place of residence gives you and does not allow to be waived.
13. Changes to This Policy
We may update this Policy from time to time. When we do, we will change the "Effective date" at the top and post the updated Policy at /privacy-policy. If we make a material change, we will take reasonable steps to notify you, such as by email or a notice in the Store. Your continued use of the Store after an update means you accept the updated Policy.
